Boston real estate agents and brokers disciplined by state registration board

On November 24, the Massachusetts’ State Board of Real Estate Brokers and Salespersons announced disciplinary action against the following Boston-based licensees:

Elias C. Eleyi, Boston:
The Board has revoked the real estate broker license of Elias C. Eleyi. The licensee failed to return deposit funds in the amount of $28,000 to a client upon her request. Furthermore, Eleyi’s Website advertised his affiliation with salespersons with whom he was no longer affiliated. Eleyi has failed to defend in this matter.

Milo Tavoliero, Boston:

The Board has suspended Milo Tavoliero’s license for 90 days. effective June 10, 2009, but stayed the suspension and placed his license on probation for a period of six months. Tavoliero failed to remit client funds, knowingly made misrepresentations to a client, and failed to produce escrow records to the Board.

William Huppeler, Jamaica Plain:
The Board placed the broker license of William Huppeler, of Jamaica Plain, on suspension for a period of 21 days. Huppeler agreed to enter into a consent agreement in order to resolve this case. In the agreement, Huppeler admitted that in or around 2006, he arrived at a property in Jamaica Plain, and represented to the seller that he was viewing the property in the capacity of a buyer and that at no time did he disclose that he was in fact acting as a broker.

Scott-Haynes, Inc., Hyde Park:
By default, the Board revoked Scott-Haynes, Inc.’s right to renew its license to practice as a corporate real estate broker in the Commonwealth. The Board found that Scott-Haynes, Inc., in the course of representing a buyer, failed to use reasonably diligent efforts to negotiate terms and conditions of a contract acceptable to the buyer and failed to act in the best interests of its client at all times. The Board also found that Scott-Haynes, Inc. failed to provide the Board with written notice of its current business address at all times.

Edward P. Gilmartin, Boston:
Edward Gilmartin agreed to a 10-day suspension of his license to resolve allegations that he practiced as a real estate broker while his license was lapsed and failed to provide proper notice to his clients that a broker’s fee would be collected from them.

James H. Batmasian, Boca Raton, Fla. (& Cambridge):
The Board suspended James Batmasian’s attorney broker license until at least Oct. 23, 2011, concurrent with a suspension by the Massachusetts Board of Bar Overseers. Batmasian entered into an agreement that resolved allegations that he was disciplined by the BBO for a conviction of failure to pay over tax in the state of Florida.
